Florida is a no-fault divorce state. Either
party can file to legally end the marriage,
and the only grounds required are irreconcilable differences or incurable
insanity. All issues of property division,
custody, and financial support are
resolved before the final divorce judgment is signed by the judge.

An
uncontested divorce means that both parties agree on everything, such
as child support, custody, visitation, division of property and debts,
and alimony, if any. An uncontested divorce can take as little as four
weeks from the time that both parties have signed the marital
settlement agreement. If the matter is contested, that is, there are
issues which the Court has to decide, such as custody, child support,
or alimony, etc., the case can take six months or much longer.
Hopefully at some point short of a trial, the case can be settled
through compromise by both parties or through the mediation process.
